INFORMATION POLICY

 

The company FIBER  GROUP SH.P.K with registered office in Apollonia Neighborhood, Jakov Xoxa Street, palace 11 9302, Fier, Albania, NUIS L52519403R (hereinafter, “the Contractor”),  as contractor of the agreement, informs based on article 13 EU Regulation n.2016/679 (hereinafter, “GDPR”) that her data will be processed  with methods and purposes as follows:

 

 

1. Object of the Agreement

 

 

The Contractor processes the personal identification data (e.g: name, surname, business name, address, telephone, e-mail, bank and payment reference, fiscal code) – (hereinafter “personal data” or just “data”) communicated by you in establishment occasions and/or execution of contractual terms with the Contractor.

 

 

2. The Contractor of the Agreement

 

 

The Contractor of the Agreement is the company FIBER GROUP SH.P.K, with registered office in Apollonia Neighborhood, Jakov Xoxa Steeet, palace 11 9302, Fier, Albania.

3. Purpose of the Agreement and legal basis

 

 

Your personal data are processed:

 

 

a) Without your expressed consent (article 6, point.b), e) GDPR), for the following objectives

 

 

  • Signing the contract with the Owner;
  • Fulfill pre-contractual obligations, contractual and fiscal obligations arising from the relationship with potential partner;
  • Protection of credit rights and the best management of our rights related to the individual contractual relationship with potential partner;
  • Fulfill the obligations determined by law, by a regulation, from the Legislation Community or from an order given by the Authority (e.g anti money-laundering purposes);
  • Exercise the rights of the Owner( e.g the right of defense in court).

 

 

b)Only with your expressed consent (article 7 GDPR) for the following objectives

 

 

Through e-mail, mail and/or sms and/or whatsapp and/or contact number, sending or contacting:

  • Newsletter, business proposals and/or advertising materials about products or services offered by the Contractor and detecting the satisfaction degree on the quality of the product or service;
  • Sending e-mail, mail and/or sms and/or whatsapp and/or contact number for conducting market analysis, statistics and quality control, marketing operation, information activities about future commercial initiatives, new products and services;
  • Sending data to the third parties for the objectives not related to the necessary contractual obligations.

 

Please note that if you are already a customer or a supplier, we can send you business proposals, customized according to the service or product of the Contractor, similar to those you have already used, only with your consent.  

 

 

4.Processing methods and Security

 

 

The personal data you have provided will be used in compliance with the aforementioned regulation and privacy obligations to which the activity of the Contractor is based. The data will be processed with both, computer tools and on paper.

In this regard we inform that the Data Processor takes all the reasonable measures to protect from data loss, misuse or access, disclosure, alteration or unauthorized destruction.  Please take into consideration that the transactions via internet are never safe or error free.

 

 

5.Recipients of the Data

 

 

Within the relevant limits relevant to the purposes of processing (implicit or explicit), the data can be communicated to:

 

  • Employees and collaborators of the Contractor;
  • A business partner;
  • Credit institutions;
  • Dept Collection Companies;
  • Credit Insurance Companies;
  • Professionals and External Consultants;
  • Subcontractors if engaged in the execution of the activity related to our contractual relationship;
  • Persons specifically appointed and/or authorized by the Contractor who provide the same services such as data processing, consulting, budget certifications, or that however develop instrumental activities, complementary or functional to that of the Contractor in execution of the activity relating to the contractual relationship;
  • All the subjects to whom the communication must be delivered due to the legal obligations.

 

6.Data Communication

 

 

 

Without the necessity of an expressed consent (article 6. point b) and c) GDPR), the Contractor can communicate the data referred to the point 1 to the Supervisory Bodies, Judicial Authorities, insurance companies for the provision of insurance services, as well as to the subjects to whom the communication is mandatory by law for the accomplishment of the purposes said. The subjects will process the data as independent processors.  Your data will not be dispersed.

 

7.Data Transfer Abroad

 

 

 

The personal data is maintained in offices and/or transferred (digitally) in Italy as established in the contract for data transfer, from time to time, structured in compliance with the business customer.

 

 

8. Retention Period

 

 

The collected data will be kept for a period of time not exceeding the achievement of the purposes for which they are processed (“conservation limitation principle” article 5, GDPR) or based in the termination period decided by law.

The Data processor will process the personal data for the time necessary to fulfill the aforementioned purposes, however for no more than 5 years from the termination of the relationship for the purposes referred to paragraph1 above and for no more than 1 one year from the collection of the data for the purposes referred to in the paragraph 2.

The verification of the obsolescence of the data stored for purposes they were collected is carried out periodically.

 

 

9.The nature of providing the data and the consequences of refusing to answer.

 

 

The data provision for the purposes referred to in the paragraph 1 is obligatory.  In their absence, we cannot guarantee the fulfillment of the provisions of the point 1.

The provision of data for the purposes referred to paragraph 2 above is optional.

It can decide not to give any data or to subsequently deny the possibility of processing data already provided.

 

 

10.Rights of the interested party

 

 

As the interested party, you have the rights referred to in article 15 GDPR and precisely the rights of:

 

a) Obtaining the confirmation of the existence or not of personal data concerning you, even if not yet registered, and their communication in an understandable form;

 

b) Obtain the indication of ;

 

  • The origin of the personal data;
  • The purposes and methods of processing;
  • The logic applied in case the processing is carried out with the help of electronic tools;
  • The identification details of the Contractor, the managers and representative appointed pursuant to the article 3, paragraph 1, GDPR;
  • The subjects or categories of subjects to whom the personal data can be communicated or who can be acknowledged as representatives appointed in the State territory, managers or agents.   

   

c) Obtain:

  • Updating, rectification or, when interested, integration of the data;
  • Cancelling, the anonymous transformation or blocking of the data processed in violation with the law, including those that do not need to be kept for the  purposes for which the data were collected or subsequently processed:
  • Certification that the operations referred to in the subparagraphs  i) and ii) have been brought to the attention, also with regard to their content, to those to whom the data have been communicated or dispersed, except the case when the fulfillment proves the impossible or involves the use of tools clearly disproportionate respect to the protected rights.
  1. To object, total or partially:
  • For legitimate motives, the processing of personal data concerning you, even if relevant to the scope of the collection;
  • For the processing of personal data concerning you to send advertising material or direct sale or for market research or business communications,  through the use of automated phone call systems without the intervention of an operator by email and/or through traditional marketing methods by telephone and/or paper. It should be noted that the opposition right of the interested party, expressed in the point ii)  for purposes of direct marketing through automated methods, it extends to the traditional ones and it remains the possibility for the interested party to exercise the right to oppose even partially. Therefore, the interested party can decide to receive only communications using traditional methods or only automated communications or none of the mentioned communication types.

 

Where applicable, has the rights referred to in article 16-21 GDPR (right of rectification, the right to be forgotten, right to limitation of processing, right to data portability, right of opposition) as well as the right to complain to the Guarantor Authority.

 

 

  • How to exercise the rights

 

 

If you believe that any information we obtain is incorrect or incomplete, you may request to view the information, correct or delete it. Please contact us via the Data Access Request Form that can be requested by email dpo@wearefiber.com.

 

In case you want to complain about the way we have managed your personal data, contact the responsible person for the data protection by dpo@wearefiber.com or via paper to the address FIBER  GROUP SH.P.K with registered office in Apollonia Neighborhood, Jakov Xoxa Street, palace 11 9302, Fier, Albania.  Our DPO will examine your claim and work with you to solve the problem.

 

If you believe that your personal data are not managed according to the law, you can contact the Guarantor Authority for the Protection of personal data by email info@kmdp.al and send a complaint.
